Version: draft · last updated 14-10-2026
These terms and conditions apply to any use of Waffinnity, a service of Appfinnity, based in Lisse, the Netherlands, Chamber of Commerce (KVK) number 91513634, VAT number NL865678674B01 ("Appfinnity", "we"). By creating an account or using the service you agree to these terms.
1. Definitions
- Service: the Waffinnity platform with which customers protect their websites, web applications and APIs, including a web application firewall, DDoS mitigation, IP reputation filtering, TLS certificates and caching.
- Customer: the organization that registers and takes out a subscription.
- User: an individual who has access to the service on behalf of the customer.
- Protected application: a website, web application or API that the customer has protected through the service.
2. Formation of the agreement
The agreement is formed the moment the customer registers, agrees to these terms and the privacy policy, and the first payment is successfully processed. Registration is open to organizations; an individual cannot subscribe to the service as a consumer.
3. The service
We make every effort to deliver and keep the service available with due care, but do not guarantee uninterrupted or error-free operation. Specific availability guarantees (SLAs) apply only when agreed in writing. We may change, extend or adapt the service and its underlying infrastructure, provided the core functionality for the customer is maintained.
The customer remains responsible for the content, operation and lawfulness of the protected application. We provide a security layer, not content oversight of what is offered through that layer.
4. Subscription, pricing and payment
Current prices are listed on the website and exclude VAT. The subscription consists of a fixed base fee including one protected application, plus a fixed fee per additional active application. Billing and automatic collection run through our payment provider Mollie; by activating a mandate you authorize periodic automatic collection of the amount due at that time.
The subscription can be cancelled monthly, unless otherwise agreed in writing. If a payment fails, protection may temporarily enter a recovery period; if payment remains outstanding, we may suspend or terminate the service.
We may adjust prices. Price changes are announced at least 30 days in advance; in the event of a price increase, the customer may cancel the subscription effective the date the change takes effect.
5. Use of the service
The customer may not use the service to facilitate unlawful, illegal or infringing content or activities, and may not cause damage to the service itself, other customers or third parties (for example by misusing the infrastructure to send attack traffic). We may suspend the service for a protected application when we reasonably suspect this is happening, and will inform the customer as soon as possible.
6. Personal data
When using the service we process personal data of the customer and its users as described in our privacy policy. To the extent that, in delivering the service, we process personal data belonging to visitors of the customer's protected application, we do so as a processor on the customer's behalf; a separate data processing agreement can be entered into for this.
7. Liability
Our liability for damages arising from use of the service is, to the extent permitted by law, limited to the amount the customer has paid us in the three months preceding the event causing the damage. We are not liable for indirect damages, consequential damages or lost revenue. This limitation does not apply in the event of intent or deliberate recklessness on our part.
8. Force majeure
Neither party is obliged to fulfil an obligation if prevented from doing so by force majeure, which includes at least: outages at internet providers, DDoS attacks exceeding our own protection capacity, and government measures.
9. Termination
Either party may terminate the agreement subject to a notice period of 7 days. We may terminate the agreement with immediate effect in the event of a serious breach of these terms by the customer. After termination, protection of the relevant applications is discontinued; data is deleted in accordance with our privacy policy.
10. Changes to these terms
We may change these terms. We will inform the customer of material changes; continued use of the service after the change date constitutes agreement to the amended terms.
11. Governing law and disputes
These terms and the agreement are governed by Dutch law. Disputes will be submitted to the competent court in Rotterdam, unless mandatory law provides otherwise.
